Booking Terms and Conditions

Purpose

The Client requests crew for their recreational vessel charter period from Tripulacion.net, and this request shall have no cost for the Client.

Duration

The duration shall be 1 week.

Price

The skipper’s fee shall be €256 per day, plus meals and transport costs, including inter-island transport, for skippering the vessel rented by the Client.

The hostess’s fee shall be €220 per day, plus meals and transport, for carrying out cooking, waitress service and interior cleaning duties, if this service is of interest to the Client.

Operation

  1. The Client requests the availability of the SKIPPER and the HOSTESS.
  1. Once a SKIPPER has been assigned for the dates requested by the Client, the Client must make a deposit of €282 into the company’s bank account as a calendar-blocking fee for the assigned skipper. An additional €282 shall be paid if the Client requests the hostess service.
  1. Before embarkation, Tripulacion.net will assist the Client with any questions they may have regarding navigation, routes, bookings, provisioning and similar matters.
  1. The Client must inform Tripulacion.net of the name of the boat, the port of embarkation and the boat owner/operator.
  1. Tripulacion.net will send the skipper’s documentation to the boat owner/operator.
  1. Tripulacion.net will provide the crew’s contact details one week in advance so that all details can be agreed.
  1. On the day of embarkation, the SKIPPER will arrive punctually at 16:00 at the indicated location to complete the check-in process with the BOAT OWNER/OPERATOR and the CLIENT.
  1. The Client must pay the skipper, and the hostess if applicable, the remaining amount for the service in cash on the day of embarkation. Otherwise, the boat may not set sail.
  1. During navigation, the SKIPPER undertakes to act in a fully professional manner and in accordance with the Blue Flag code of conduct. See Annex I.
  1. On the day of disembarkation, the SKIPPER will assist with the vessel check-out process with the BOAT OWNER/OPERATOR and the CLIENT. The service will end at 18:00.
  1. Skippers usually eat with you. When you go out for dinner at restaurants, the skipper may accompany you or provide you with receipts for the costs, which you may then reimburse. The usual cost is approximately €25 per meal allowance.

Cancellations

Cancellations by the Client are only accepted with 15 days’ notice. If the Client cancels at least 15 days in advance, the amount paid in advance will be refunded, minus management fees.

If the Client cancels less than 15 days in advance, no refund will be made.

If the skipper cancels with 15 days’ notice, there will be no cost for the skipper.

However, if the booking is cancelled within 15 days before the reservation, the booking amount will not be refunded.

If Tripulacion.net cancels the booking, it shall refund the CLIENT the amount it has received from them.

Responsibilities

The SKIPPER shall be responsible for any civil and criminal liability in the event that the boat and/or its occupants suffer any type of accident, damage or death due to the skipper’s negligence.

Data Protection

In relation to the processing of personal data that may arise from compliance with the obligations described in this Agreement, the Parties agree to comply with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, hereinafter “LOPD”, its implementing regulations and any other legislation on personal data protection in force at any given time. Each Party undertakes to hold the other Party harmless against any type of damage or loss, expense and/or sanction of any kind, whether civil, criminal, administrative or labour-related, and in particular in the event of the initiation of any type of proceedings by the Spanish Data Protection Agency, which may arise for the other Party as a result of the breach or non-compliance by either Party with the obligations set out in personal data protection legislation in relation to this contract. Consequently, each Party agrees to pay any amount for which the other Party may be ordered to pay by way of sanction, fine, compensation, damages, losses and interest under the terms set out in the previous paragraph, including reasonable lawyers’ and court representatives’ fees, even where their involvement is not mandatory, as well as court costs. For the purposes of receiving any notification related to the rights and obligations recognised in this contract, the address stated in the heading of the contract is designated. The Parties submit, as required by law, to the Courts and Tribunals of Palma de Mallorca, the place where the contracting party is located. The Parties grant this document full legal binding force and confirm and ratify its contents, undertaking to comply duly and faithfully with all its clauses and conditions, signing it in duplicate at the place and on the date indicated in the heading.

Definitions:

Skipper: the person holding a professional skipper’s licence or higher qualification, responsible for operating the vessel. The skipper is the highest authority on board, both in terms of safety and operation of the vessel, and all crew members must follow their instructions.

Hostess: the person responsible for meal and cocktail service, as well as cleaning the bathrooms thoroughly twice a week and superficially on a daily basis. The hostess will prepare breakfast, lunch and meals, as dinners are taken outside the boat.

Crew agency: the company responsible for acting as intermediary in the crew selection process.

Client: the person who enjoys the vessel charter as the holder of the charter contract signed with the BOAT OWNER/OPERATOR. The Client may differ from the person or entity paying for the service, for example, in the case of charters by legal entities or companies.

Boat owner/operator: the owner or exclusive manager of the vessel chartered by the Client. Their main activity is the chartering of vessels, which are legally authorised for charter use.
